1Agreement
These terms are an agreement between you and Lysander Ventures, LLC, a Delaware limited liability company, together with its successors and assigns (“we”, “us”), for your use of Search the Home at searchthehome.com and app.searchthehome.com (the “service”). By creating an account or paying for a subscription, you agree to these terms, our privacy policy and our refund policy.
PLEASE READ SECTION 17. IT REQUIRES MOST DISPUTES TO BE RESOLVED BY INDIVIDUAL ARBITRATION, AND YOU GIVE UP THE RIGHT TO A JURY TRIAL AND TO TAKE PART IN A CLASS ACTION.
2Who can use the service
You must be at least 18 and a resident of the United States.
3Your account and credentials
You sign in with passkeys or other credentials, and your data is encrypted with keys derived from them. You are responsible for keeping your credentials and devices secure. We generally cannot recover your account or data if you lose your credentials, and we are not responsible for data you cannot access because of that. Keep more than one passkey and set up a way to recover your account, such as a recovery code.
4Subscriptions and automatic renewal
- Each subscription covers one home. Prices are shown at checkout. We may change prices and, at our discretion, offer discounts.
- Your subscription renews automatically each year at the then-current price, and we charge your payment method on file, until you cancel.
- You can cancel at any time online from your account menu. Cancelling stops the next renewal, and you keep access until the end of the period you paid for. Payments are refundable only as our refund policy says.
- If we change the price of your subscription, we will email you 7 to 30 days before the change takes effect, with instructions for cancelling.
- If a payment fails, we may retry it. If we cannot collect payment, your subscription will end.
5Paying before you create an account
You can buy a subscription before you set up an account. You’ll usually claim it by creating your account right after you pay. Your subscription term starts when you pay, not when you claim it.
6Gift subscriptions
A gift subscription is a prepaid one-year subscription that you buy for someone else. It does not renew automatically. The one-year term starts when you buy the gift, not when the recipient activates it. At our discretion, we typically extend the service so it lasts until one year after the recipient activates it, but we do not guarantee that extension. Gift subscriptions are never refundable, including when no one activates them, except where the law requires. The recipient activates the gift with a code; keep it private, because anyone who has it can use it. Gift codes cannot be resold or exchanged for cash, except where the law requires. When a gift ends, nothing is charged unless the recipient chooses to subscribe.
7Discounts and promotions
At our discretion, discounts may be available in special cases, such as promotions tied to referrals by existing members, or in other circumstances. Discounts have no cash value, and we may change or end any offer at any time.
8Your content
Everything you add to the service is yours. You give us only the permission we need to store, copy, back up, transmit and process your data to provide the service, including to people you share a home with and to features and services you choose to use. You are responsible for having the right to store what you add.
9Shared homes and recovery accounts
You can invite other accounts to a home or set one up as a recovery account. People you invite may be able to see, change or copy information in that home, and to add or remove members or data, so only invite people you trust.
10AI features and connected services
AI features such as voice search, dictation and AI agents may give inaccurate or incomplete results. Check anything important. If you connect a third-party service, such as an AI app through a connector, that service is not ours: it will hold the credentials needed to decrypt your data, protected by its own security, and its own terms and privacy policy govern the data you make available to it. If your account with that service is compromised, whoever controls it may be able to reach your Search the Home data. We are not responsible for third-party services.
11Acceptable use
Do not use the service to break the law, harm other people, or store content you have no right to store. Do not try to get into accounts or data that are not yours, interfere with or overload the service, probe it for security holes without our permission, or resell it. If you find a security problem, please tell us at security@support.searchthehome.com.
12Suspension and ending
You can cancel your subscription at any time, and ask us to delete your account by emailing help@support.searchthehome.com. We may suspend or end your access if you break these terms, or if we need to in order to protect the service, other users or ourselves. What happens to your data after a subscription ends is described in our privacy policy.
13Changes to the service
Search the Home is a new product and actively under development. We may add, change or remove features at any time.
14Disclaimers
TO THE FULLEST EXTENT THE LAW ALLOWS, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT PROMISE THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE, OR THAT YOUR DATA WILL NOT BE LOST. KEEP YOUR OWN COPIES OF ANY INFORMATION YOU CANNOT AFFORD TO LOSE.
15Limitation of liability
TO THE FULLEST EXTENT THE LAW ALLOWS: (A) WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOST DATA, PROFITS, REVENUE OR GOODWILL, EVEN IF WE WERE TOLD THEY WERE POSSIBLE; AND (B) OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. These limits apply to every legal theory and survive the end of these terms. They do not limit liability that the law does not allow to be limited.
16Indemnity
To the extent the law allows, you will cover our losses and reasonable costs, including legal fees, from claims by others that arise from your breach of these terms or from content you store or share.
17Disputes, arbitration and class action waiver
Talk to us first. Before starting any claim, send a written description of the dispute and what you want to help@support.searchthehome.com and to Lysander Ventures, LLC, c/o A Registered Agent, Inc., 8 The Green, Ste A, Dover, DE 19901. We will do the same. Neither of us may start arbitration or a court case until 60 days after that notice.
Binding individual arbitration. Any dispute between you and us relating to the service or these terms will be resolved by binding arbitration on an individual basis, administered by the American Arbitration Association under its Consumer Arbitration Rules, except as this section says. The Federal Arbitration Act governs this section. The arbitrator decides all questions, including whether a dispute must be arbitrated, except as the class waiver below says. Hearings may take place by video, or in San Mateo County, California, unless the rules require somewhere else. Fees are paid as the rules require.
Exceptions. Either of us may bring an individual claim in small claims court. Either of us may ask a court to stop misuse of the service or of intellectual property. A claim for public injunctive relief will be decided by a court, after any individual claims are arbitrated.
No class actions or jury trials. You and we may bring claims only individually, not as a plaintiff or member of a class, collective or representative action, and both of us give up the right to a jury trial. If this class waiver is found unenforceable for a claim, that claim goes to court, not to class arbitration.
Mass filings. If 25 or more similar arbitration demands are filed by or with help from the same lawyers, they will be handled under the arbitration provider’s mass arbitration rules.
Time limit. To the extent the law allows, any claim must be started within one year after it arises, or it is permanently barred.
Opting out. You can opt out of arbitration by emailing help@support.searchthehome.com within 30 days after you first agree to these terms, saying you opt out of arbitration.
Courts and governing law. Anything not arbitrated will be decided only in the state or federal courts for San Mateo County, California, and you and we agree to their jurisdiction. These terms are governed by the laws of the State of California, without regard to conflict-of-law rules, except that the Federal Arbitration Act governs this section.
18Changes to these terms
We may change these terms. For a material change, we will email you or show a notice in the app before it takes effect. If you keep using the service after that, you accept the new terms. Changes to section 17 do not apply to disputes already pending.
19General
These terms and our privacy and refund policies are the whole agreement between us about the service. If we do not enforce a term right away, we can still enforce it later. You may not transfer these terms. We may transfer or assign these terms, including your subscription and its automatic renewal, to an affiliate or to a successor in a merger, acquisition, reorganization or sale of assets, without further notice or consent, and the successor may continue the service and charge renewals under these terms.
Severability. If any part of these terms is found invalid, illegal or unenforceable, that part will be enforced to the fullest extent the law allows and changed only as much as needed to make it enforceable, and the rest of these terms stays in full effect. This applies in particular to the disclaimers, the limitation of liability, the indemnity and section 17, except that if the class action waiver is found unenforceable for a claim, that claim goes to court as section 17 says.
